Ferrari Wins Back the Rights to its Testarossa Trademark

December 2, 2020

--

According to CourtHouseNews, Ferrari’s legal battle against German toy company Autec AG to maintain the right to use its earlier-trademarked name “Testarossa” has ended in a victory for the Italian auto manufacturer.

Last month, the European Court of Justice reportedly overruled a German court decision rescinding Ferrari’s right to use the name of one of its most famous cars. The European high court found that, although the model for the trademarked name had not been produced since the 1990s, the fact that Ferrari continued to produce and sell replacement parts for Testarossa customers was sufficient to hold on to trademark rights.
