Ben Hackett of the Goodmans IP Team has authored an article for the Intellectual Property Institute of Canada ("IPIC") regarding IPIC's successful intervention before the Federal Court of Appeal in Canadian National Railway v. BNSF Railway, 2020 FCA 45.
In its decision, the Federal Court of Appeal clarified the test for determining the availability of protective orders in patent litigation in Canada.
IPIC was represented by the Goodmans IP Team, including Andrew Brodkin, Ben Hackett and Carlie Fox.
