Hanes' "Champion" Trademark Claim Dismissed for Lack of Jurisdiction

As reported by Reuters, Keds has successfully had a trademark claim brought by Hanesbrands Inc ("Hanes") in Massachusetts dismissed for lack of jurisdiction. The claim related to the use of the “Champion” name.


The key question was whether a US court has jurisdiction over Hanes’ trademark claims, which relate solely to its alleged rights in “Champion” outside the US.


The Court found that it lacked jurisdiction over Hanes’ claims, which attempted to “shoehorn” Hanes’ alleged foreign trademark rights into the Lanham Act.
