Ohio State and Marc Jacobs Agree to "Cease Fire" Over Use of "THE" Mark

As reported by NBC News, The Ohio State University and Marc Jacobs have filed an agreement with the United States Patent and Trademark Office (the "USPTO") allowing both parties to use "THE" on their products until the USPTO makes further rulings regarding their competing trademark applications.


The university reportedly filed an application for "THE" in August 2019 but later learned that Marc Jacobs had already submitted a similar application in May 2019.


The university insists that it has referred to itself as The Ohio State University since 1878, to distinguish itself from other colleges in Ohio.
